General Terms and Conditions (GTC)

1. Scope

These GTC apply to all orders placed by consumers (§ 13 BGB) in the online shop of Tarek Shater - Shater Studios

3. Offer and Conclusion of Contract

(1) Product representations are non-binding.

(2) In checkout, you submit a binding offer. We accept this by sending an order confirmation or by dispatching the goods.

(3) You can make corrections before submitting the order via the input fields and back functions provided in the shop.

4. Prices, Taxes and Shipping Costs

(1) All prices in EUR including statutory VAT.

(2) Shipping costs vary depending on product and destination and are displayed at checkout.

(3) For deliveries outside the EU, additional costs (customs duties, taxes, fees) may apply, to be borne by the buyer.

5. Delivery, Delivery Times, Partial Deliveries

(1) Shipping from Berlin with GLS, Hermes, DPD or DHL; delivery countries: worldwide.

(2) Standard delivery times: domestic 1–10 business days, international 5–25 business days.

(3) Certain items, are available for preorder before the official rollout. Preordered items will be dispatched according to the estimated release schedule specified on the product page. Customers will be notified of any changes to the delivery date. Payment for preorders is processed at the time of order.
(4) Partial deliveries are permitted where reasonable; no additional shipping costs will be incurred by the customer.

(5) Certain products may be delivered by freight forwarding (delivery to curbside; no assembly). Any special conditions are specified in the product description.

6. Payment

Payment methods: Shopify Payments (including credit card, Apple Pay, Google Pay), PayPal, Klarna (if available).

The payment time depends on the option shown at checkout; generally upon order.

7. Right of Withdrawal (Consumers)

(1) You have a statutory right of withdrawal of 14 days. The period begins upon receipt of the goods.

(2) You bear the direct costs of return shipping. Unpaid returns will not be accepted.

(3) We may claim compensation for diminished value if this is due to handling not necessary to test the condition, properties and functionality of the goods.

(4) Statutory exceptions to withdrawal (e.g. for custom-made/made-to-order goods) remain unaffected. Currently, we do not offer custom-made products.

(5) Refund: within 14 days from receipt of your withdrawal declaration, but not before we have received the goods or proof of their return.

8. Transport Damage

Please report obvious transport damage to the carrier immediately and contact us without delay. Failure to do so has no effect on your statutory claims and their enforcement, but helps us with processing.

9. Statutory Liability for Defects (Warranty)

The statutory defect liability law applies. Additional warranties are not granted unless expressly stated for the respective product.

10. Liability

(1) We are fully liable for intent and gross negligence as well as for injury to life, body or health.

(2) In cases of simple negligence, we are only liable for the breach of an essential contractual obligation (cardinal duty); in such cases, liability is limited to the typical, foreseeable damage.

(3) Liability under the Product Liability Act remains unaffected.

(4) Safety instructions (e.g. weight, risk of crushing, protection of flooring) must be observed. We are not liable for damages resulting from clearly improper or non-purposeful use.

11. Retention of Title

The goods remain our property until full payment has been received.

12. Voucher and Discount Codes

(1) Discount codes are non-transferable, only redeemable once per order, not combinable with other promotions and not payable in cash.

(2) Codes may have a time limit and product-specific restrictions; details according to the respective promotion description.

13. Storage of Contract Text

We will send you the order data and these GTC by e-mail. The GTC can be viewed at any time on our website.

14. Online Dispute Resolution and Consumer Dispute Settlement

EU Commission platform for online dispute resolution: https://ec.europa.eu/consumers/odr

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

15. Applicable Law, Place of Jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers with habitual residence in the EU, mandatory consumer protection provisions of their country of residence remain unaffected. For merchants, the exclusive place of jurisdiction is Berlin.

Withdrawal Policy

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us (Tarek Shater - Shater Studios, Gneisenaustraße 30, 10961 Berlin, Germany, E-Mail: contact@shaterstudios.de) of your decision to withdraw from this contract by means of a clear declaration (e.g. by e-mail). You may use the attached sample withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send the notification of exercising the right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments we have received from you, including delivery costs (except for additional costs arising if you chose a type of delivery other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we receive notification of your withdrawal.

For this refund we will use the same means of payment that you used in the original transaction, unless expressly agreed otherwise; in no case will you be charged fees for this refund.

We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you informed us of the withdrawal. The deadline is met if you dispatch the goods before the fourteen-day period has expired.

You bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods if this loss in value is due to handling not necessary for testing the condition, properties and functioning of the goods.

Exclusion or Early Expiry of the Right of Withdrawal

The right of withdrawal does not apply to contracts for the supply of goods which are not prefabricated and for whose production an individual choice or specification by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer (currently not offered).
